GENERAL PROVISIONS

  • These Terms and Conditions apply to agreements concluded through the Internet Shop available at www.zabezpieczono.pl. The Rules and Regulations set out in particular the principles for placing Orders. These Regulations are an integral part of the Agreement concluded through the Internet Shop.
  • The owner, operator and administrator of the Internet Shop is ZABEZPIECZONO Spółka z ograniczoną odpowiedzialnością with its registered office in Siedlce, address: ul. Składowa 59, 08-110 Siedlce, registered in the Register of Entrepreneurs of the National Court Register by the District Court Lublin Wschód in Lublin with its seat in Świdnik, VI Economic Department of the National Court Register under the number 0001098023, NIP 8212690930, REGON 528265043.
  • The Buyer has the right to negotiate the provisions of the Contract with the Seller before placing the Order.
  • In matters concerning Contracts concluded through the Website, not regulated in these Regulations, the provisions contained in the General Terms and Conditions of Sale/Delivery Contracts, available at the website zabezpieczono.pl and www.sparkz.pl, shall apply. In particular, the provisions concerning: Delivery and return of Goods, Consumer's rights and submission of complaints.

DEFINITIONS

Regulations - these Rules of Procedure and their annexes;

Salesperson / ASSOCIATED - ZABEZPIECZONO Spółka z ograniczoną odpowiedzialnością with registered office in Siedlce, address: ul. Składowa 59, 08-110 Siedlce, registered in the Register of Entrepreneurs of the National Court Register by the District Court Lublin Wschód in Lublin with its seat in Świdnik, VI Economic Department of the National Court Register under the number 0001098023, NIP 8212690930, REGON 528265043, however for the purposes of these Regulations it is permissible to use the designation Seller or ZABEZPIECZONO interchangeably;

Buyer / recipient - a natural person, a legal person or an organisational unit to which legal personality has been granted by legal regulations, concluding an Agreement with the Seller, referred to in these Terms and Conditions, directly related to its business or professional activity, whereby for the purposes of these Terms and Conditions it is permissible to use the designation Buyer or Recipient interchangeably;

Consumer - A buyer who is a natural person, concluding with ZABEZPIRE an Agreement referred to in these Terms and Conditions not directly related to his/her economic or professional activity;

Page / Pages - the Seller or the Buyer (or the Consumer) respectively or jointly the Seller and the Buyer (or the Consumer);

User - any entity using the Online Shop;

Online shop - run by ZABEZPIRE an online shop operating at the following internet address: www.zabezpieczono.pl.

Goods - items sold by ZABEZECZONO via the Online Shop;

Contract - a contract of sale concluded by the Parties at a distance via the Internet Shop;

Order - an offer to conclude a Contract made by the Buyer via the Internet Shop;

Account - the User's individual administration panel available after registration and logging in to the Online Shop, marked with a login and password, for the purpose of concluding Contracts;

Registration- the process involving the creation of an Account by the User in the Online Shop;

Annexes- information on the right of withdrawal and a model withdrawal form;

Information - information about the Goods, located next to a picture of the Goods, which constitutes a description of the most important terms and characteristics of the given Goods, enabling the Buyer to become acquainted with their properties;

Basket- a form of storage of goods selected by the buyer for subsequent purchase;

Services provided by electronic means - the functionality of the data communication and IT system that enables the COMPANY to offer certain technical solutions such as: the possibility of creating and maintaining an Account in the Online Shop; and enabling a one-time possibility of placing an Order through the Order Form located in the Online Shop; without the simultaneous presence of the Parties (at a distance), through the transmission of data at the individual request of the Recipient, sent and received by means of devices for electronic processing, including digital compression, and storage of data, which are entirely transmitted, received or transmitted by means of a telecommunications network within the meaning of the Act of 16 July 2004. - Telecommunications Law;

Order Form - a technical system located in the Online Shop which makes it possible to place an Order by the Buyer through the available form fields, without the need to register first with the Online Shop;

 

USE OF THE ONLINE SHOP

  • The Buyer may place Orders on the Online Shop 24 hours a day, 7 days a week.
  • The Buyer may place orders for and purchase Goods through the Online Shop:
  1. after prior registration or;
  2. without the need for registration.
  • Registration in the Online Shop is voluntary and free of charge.
  • In order to register with the Online Shop, the User should fill in the registration form located on the Shop's website, providing his/her true data. After the User fills in the fields of the registration form with the required data, a User Account will be created.
  • In the event that the User data required during the registration process changes, the User is requested to update this data to bring it into line with reality.
  • The Buyer who has registered is obliged to protect access to his own Customer Account, in particular by protecting the confidentiality of his Account password.
  • A Buyer making a transaction via the Online Shop without prior Registration should follow the messages displayed on the Online Shop website when placing an Order via the Order Form.

INFORMATION ON GOODS AND PRICES IN THE WEBSHOP

  • Information about the Goods available on the pages of the Internet Shop constitutes an invitation to conclude a contract within the meaning of Article 71 of the Civil Code.
  • Specifications, descriptions and drawings of the Goods displayed on the Website are for illustrative purposes only and do not constitute part of the offer, unless expressly referred to in writing in such offer. In particular, the appearance of the Goods in the images presented in the Online Shop may differ slightly from the external appearance of the Goods issued to the Buyer, which differences may result from different settings of the Buyer's monitor, lighting conditions,
  • Announcements, advertisements, price lists and other Information placed in the Online Shop shall be regarded, in case of doubt, not as an offer but as an invitation to conclude a Contract. They also do not constitute an assurance by the Seller.
  • The prices given in the Online Shop are expressed in net and gross values and are given in Polish zloty.
  • The prices of the Goods indicated on the website of the Online Shop do not include delivery costs and any costs related to the selection of the payment option upon delivery. The Buyer decides during the placement of the Order which delivery method he chooses. The costs of delivery are specified in relation to each of the available delivery methods, respectively.
  • The Buyer shall purchase the Goods and Order the Service at the prices and delivery costs in force at the time the Order is placed.
  • The Seller reserves the right to make changes to the prices of the Goods, conduct and cancel promotional actions and sales, or make changes to them. The aforementioned right shall not affect the prices of the Goods in Orders placed before the effective date of the price change, terms of promotional actions or sales.
  • Shipping prices for Orders within Europe are subject to change, but the Seller shall not proceed with the Order without accepting the changed shipping price. The Buyer will be informed of the change at the time of commencement of the Order. If the Buyer does not accept the change by 3 working days, the Order will be cancelled.
  • The current prices and amounts of delivery costs are presented on the subpage of the Online Shop and are visible at Basket level.

PLACING AN ORDER

  • In order to place an Order, the Buyer should add the Goods he intends to purchase to the Basket. The addition of Goods to the Basket is not tantamount to placing an Order. Goods may be freely added or removed from the Basket.
  • The shopping basket allows the Buyer to manage the Goods ordered and to calculate the value of the Order.
  • When placing an Order, the Buyer may enter comments by inserting them in the space provided on the Order Form.
  • The final stage of placing the Order is to specify the form of invoice (receipt or VAT invoice).
  • Once a valid Order has been placed, the Buyer is shown the buyer's details and address data, as well as the amount of the Order and the form of its execution. If the Buyer accepts all the elements he has selected, he must select the "order and pay" button in order to successfully place the Order.
  • An Order placed by the Buyer will be confirmed by e-mail. It only constitutes a confirmation of the delivery of the Order to the Internet Shop's e-mail server.
  • The Seller shall examine the Order placed in terms of its feasibility and the correctness of its execution by each Party. The acceptance of an Order is conditional on the availability of goods in the Seller's warehouse and the absence of errors on the part of the system used by the Online Shop.
  • ZABEZEZPIRE shall inform the Buyer in the event of unavailability of all or part of the Goods covered by the Order in the Online Shop.
  • The BROKER is entitled to refuse to accept an Order placed by the Buyer for legitimate reasons, in particular if:
  1. The purchaser has in the past placed an Order at least twice, which has not subsequently been taken back without indicating the reasons and without informing BROKER of the withdrawal;
  2. the circumstances surrounding the Order indicate the possibility of fraud.
  • The Seller reserves the right to impose limits on orders of specific Goods by Customers, in particular when such Goods are offered in promotions. Limitations shall be indicated each time on the Website of the Online Store.
  • ZABEZONE will inform the Buyer by e-mail in the event that the order is refused for the reasons indicated in paragraphs 8 - 9 above.
  • In the event of unavailability of some of the Goods covered by the Order in the Seller's warehouse or for other reasons preventing execution of the Order in the time or to the extent provided for therein /including in particular, but not exclusively, a delay in delivery/, the Buyer is informed of the status of the Order and decides on the manner of its execution.
  • The buyer has the following options in the event of the situation described in point 12 above:
  1. Partial fulfilment - the Purchaser's choice of this option results in the fulfilment of the Order concerning only available Goods, the Seller is relieved from the obligation to fulfil the Order for unavailable goods;
  2. cancellation of the Order in its entirety - the Buyer's choice of this option releases the Seller from the obligation to perform the Order.
  • If the Buyer has paid for the Goods in the situation presented in points 12 and 13, the Seller shall refund the amount due to the bank account indicated by the Buyer.
  • In the event that payment is not made within 7 days from the date of placing the Order, BETTER reserves the right to automatically cancel the Order.
  • The ordered Goods will be delivered to the address indicated by the Buyer.
  • The date of performance of a Contract concluded via the Online Shop shall be the date of receipt of the consignment by the Buyer.
  • The BROKER may contact the Buyer at the e-mail address provided or by telephone at the contact telephone number indicated by the Buyer to clarify any doubts, to confirm the Order or for any other issues related to the execution of the Order.
  • The Buyer may make changes to the Order or cancel it until the Order is sent for dispatch. Making changes is possible via the contact number +48 502 502 120 or by e-mail at [email protected].

PAYMENTS

  • The seller provides for the following types of payment:
  1. prepayment - payment by bank transfer - payment to the Seller's bank account of the full order value calculated in the calculation, before delivery of the ordered Goods,
  2. by online transfer - payment to the company's bank account of the full order value calculated in the calculation, before delivery of the ordered Goods.
  3. via the Przelewy 24 electronic payment system
  • If the payment method is selected via an Electronic Payment System, the Buyer will be redirected from the website of the Online Shop to the website of the payment system indicated above as part of the procedure for placing the Order. Once redirected to the page of the Electronic Payment System in question, the Customer should follow the procedure provided for on the page of that system in order to make payment.

GUARANTEE

  • Goods sold through the Online Shop are guaranteed by the Vendor and the Manufacturer. The Producer as well as the Seller provide a one-year guarantee for the purchased Goods.
  • Detailed terms and conditions for the implementation of the guarantee are set out in the guarantee form issued by the guarantor.

EXCHANGE, RETURN

All Goods placed in the Online Shop are non-returnable or non-exchangeable due to their manufacture as part of an individual production on the basis of an order by the Buyer.

 

PROVISION OF ELECTRONIC SERVICES

  • ZABEZONE provides the following Electronic Services via the Online Shop:
  1. setting up and maintaining an Account in the Online Shop,
  2. enabling an Order to be placed via the relevant Form.
  • The provision of electronic Services by the Service Provider is free of charge.
  • The User is obliged to use the Internet Shop in a manner compliant with the law and good manners, with due regard to respect for personal rights and intellectual property rights of third parties. The user is obliged not to provide unlawful content. It is forbidden to use electronic services in a manner which unlawfully interferes with the functioning of the Internet Shop through the use of specific software or devices, as well as sending or placing in the Internet Shop unsolicited commercial information.
  • The user may submit complaints related to the provision of the electronic service via the Online Shop by sending an e-mail to the following e-mail address: [email protected].
  • By mutual agreement between the parties, BROKER and the User may terminate the Agreement for the provision of the Service by electronic means at any time.

FINAL PROVISIONS

  • BETTER shall not be responsible for the blocking of email servers by administrators, the content and fact of sending messages to the email address indicated by the Buyer, or for the deletion and blocking of emails by software installed on the computer used by the Buyer.
  • The BROKER shall not be liable for any errors in the handling of the Order or other instructions of the Buyer resulting from the transmission of incorrect data by the Buyer.
  • ZABEZEGONO shall not be liable for transactions carried out by unauthorised third parties who have gained access to the Buyer's account as a result of the Buyer's failure to exercise care when using the login and password for the Account.
  • In matters not regulated in these Terms and Conditions, the provisions of the General Terms and Conditions of Sale/Delivery indicated in § 1 item 4) as well as applicable laws, in particular the provisions of the Civil Code and the Act on Consumer Rights, shall apply.
  • ZABEZEGONO reserves the right to amend the Regulations. Any changes to the Regulations shall come into force on the date indicated by ZABEZPIRE. Orders placed before the date of entry into force of amendments to these Regulations are executed on the basis of the provisions in force on the date of placing the Order.
  • To the fullest extent permitted by law, ZABEZEGON shall not be liable for any disruptions, including interruptions in the operation of the Shop caused by force majeure, unauthorised acts of third parties or incompatibility of the Online Shop with the Buyer's technical infrastructure.
  • ZABEZECZONO undertakes to ensure the proper operation of the Online Shop and undertakes to remove any irregularities in the operation of the Online Shop without undue delay.

  • The name of the zabezpieczono.pl Internet Shop, the address at which it is available: zabezpieczono.pl and all materials contained therein are subject to copyright and legal protection. Their use and distribution without the consent of ZABEZPIECZONO shall be prohibited.
  • These Terms and Conditions are effective as of 01.08.2023 and replace the previous Terms and Conditions of the Online Shop.
  • The Rules are subject to publication on the website www.zabezpieczono.pl. Any amendments to the Rules of Procedure shall be made in the same manner.
